Terms & Conditions

General Conditions


Driving lessons are provided by Beck’s Transport Training Pty Ltd (ABN 78 639 166 779) of Unit 7, 83 – 101 Lysaght Street, Mitchell ACT 2911 or by its contracted instructors. Where Beck’s Transport Training Pty Ltd is the provider, these terms govern the agreement between the participant (“you”) and Beck’s Transport Training Pty Ltd. Where an instructor is the provider, that instructor provides the lessons, and these terms govern your agreement with the instructor. The instructor (as the case may be) is referred to as “we”, “our” and “us” in these terms and conditions. By booking a training course (“Lesson”), you accept these terms and conditions (“Terms”).


These terms may be varied from time to time and will be updated on the website at www.beckstransporttraining.com.  You will be bound by the Terms you accept at the time of booking your lesson. If you book more than one lesson at the same time, the terms and conditions applicable at the time of booking will apply to each lesson booked at that time.


Lesson Bookings


Lessons must be booked via one of the following channels authorised by us:


  • Beck’s Transport Training Pty Ltd office on 0417 085 445 or at info@beckstransporttraining.com


Standard lesson bookings can be made up to 48 working hours prior to lesson time pending instructor availability. 


Lesson must be paid for prior to the lesson or as otherwise agreed with the office staff of Beck’s Transport Training Pty Ltd. We offer a variety of lesson products, however the accessibility of these products is dependent on the student’s skill level and experience.


Duration of lessons includes briefing and de-briefing time. Lessons commence at a pick-up point determined at the time of booking unless otherwise agree with the instructor.


Payment Conditions


All bookings must be paid for in full prior to the commencement of the lesson unless otherwise agreed with the Beck’s Transport Training Pty Ltd office staff. The instructor is not obliged to provide you with a lesson if the lesson fee has not been paid in full. If the Instructor provides you with a lesson before the lesson fee has not been paid in full, any part of the lesson fee outstanding for the lesson is a debt due to us and payable immediately on demand.


Payment can be made by cash, cheque, credit card or Electronic Funds Transfer (EFT), Direct Deposit or a valid voucher issued by Beck’s Transport Training Pty Ltd. Payment acceptance varies by booking channel and is agreed upon at the time of a booking.


We reserve the right to offer certain lesson and package types where additional booking and refund restrictions may apply. If any additional booking or refund restrictions do apply, we will notify you at the time any offer is made.


Client Responsibility 


 Licence Details & Knowledge Tests


  • Clients are responsible for ensuring they provide accurate and up-to-date licence details at the time of booking.
  • Clients must complete any state-required knowledge tests prior to their scheduled training session.
  • Failure to provide correct licence details or complete knowledge tests may result in rescheduling fees.
  • A booking will not be confirmed until licence details have been received unless requested for a bulk invoice from a company. 
  • If a company scheduled dates and licence details are not received by booking date, no show policy will come into place.
  • It is up to the client to ensure they schedule the correct licence and gearbox for the licence upgrade. If additional training or changes are required, charges may be applied. 


Booking & Invoice Terms


  • Once a booking has been made and an invoice has been issued, the cancellation and payment terms of 7 days from date of invoice.
  • Any changes or delays caused by incorrect bookings or missing licence details, may result in additional fees as outlined in the rescheduling policy. 


Overdue invoices may be charged an account keeping fee of $10.00 each month while such invoices remain outstanding.


Costs of Recovery: The Customer shall pay the Supplier for all costs incurred by the Supplier (including costs for which the Supplier may be contingently liable) in any attempt to collect any monies owed by the Customer to the Supplier under this Agreement including debt collection agent costs, repossession costs, location search costs, process server costs and solicitor costs on a solicitor/client basis.


If you enter into a Payment plan, credit card details will be held on record until all outstanding balance is cleared.


The refund offer will be determined at the discretion of Beck’s Transport Training Pty Ltd.


Fees and cancellations/rescheduled bookings


You may cancel or reschedule your appointment without charge at any time 7 working days prior to your appointment.


If you cancel with less than 7 working days’ notice, the following applies:


  • Cancellation of the course by client, more than 7 working days prior to commencement is subject to a full refund or placed in credit.
  • Cancellation of the course by you, within 7 - 4 working days prior to commencement will be subject to a refund of 50% of the total course cost.
  • Cancellations made less than 3 days before the scheduled training will not be eligible for a refund.

 

If a client books the wrong licence upgrade and requires additional training and rescheduling, additional charges for the extra training days will apply, along with 50% of the value of the original invoice.


Cancellation Due to Illness or Emergency:


In the unfortunate event that a participant needs to cancel a booking within less than 48 working hours due to illness or a genuine emergency, the following terms apply:


  1. Notification: The participant must notify us as soon as possible, providing details of the situation.
  2. Documentation: We may request relevant documentation (such as a medical certificate) to verify the illness or emergency.
  3. Rescheduling: Whenever possible, we will work with the participant to reschedule the training session to a mutually convenient time.
  4. Refund: If rescheduling is not feasible, a partial refund may be considered, subject to our discretion and the circumstances.


We understand that unforeseen situations arise, and we aim to be compassionate while maintaining fairness to all participants.


In the event of a course requiring rescheduling due to instructor illness or unforeseen circumstances, the cost of the course will be offered as either a refunded in full, or alternatively placed into credit and rescheduled at a later date. 


We reserve the right to reschedule a lesson subject to the provision of reasonable notice including telephone, email or SMS. We reserve the right to refuse to provide a lesson where you are unfit to operate a vehicle as reasonably determined by us.


If you arrive late for a lesson the instructor may only be able to offer you the remaining lesson time, if they are committed to another lesson after and you will be charged for the full lesson cost. If you are more than 10 minutes late without notifying us, we reserve the right (at instructor’s reasonable discretion) to cancel the lesson and charge the lesson fee.


If you do not attend a lesson (No Show) we reserve the right to cancel the lesson and charge the full lesson fee.


Use of own vehicle


It is the client's responsibility to ensure that if they choose to book in a licence upgrade using their own vehicle, the vehicle must meet road worthy requirements. This includes tyres, seatbelts, windscreen, registered and is the correct rated vehicle. If there is a need to change to a Beck's provided vehicle, additional charges will be incurred for the difference between the original booking invoice and the use of a Beck's vehicle. 


Promotions, Discounts & Free tuition


Any discounts or free lesson are not transferable or redeemable for cash.


Gift Vouchers


Are non-refundable, not redeemable for cash. They are not transferable and cannot be resold. Cancellation and promotional conditions apply.


Lessons


Driving lessons commence and end at the pre-determined pick-up/drop off point, determined at the time of booking the lesson. The duration of a standard driving lesson is one hour, including lesson briefing and de-briefing.


Provision of Lessons


You must hold a current Australian driving licence (Class C or the relevant heavy vehicle licence) and carry it with you at all times during a lesson. You must have your driver knowledge test results with you. For the ACT, this is a print out of your results from Road Ready Centre and for NSW, this is the HVCBA learner logbook.


Mobile phones must be switched off prior to entering the driving lesson.


You must be ready to commence the lesson at the agreed time. If you do not turn up at the agreed time for your lesson, your instructor will wait 15 minutes and may at the instructor’s reasonable discretion deduct this from the total lesson time. If you turn up outside these times, your instructor may in his/her reasonable discretion choose not to proceed with the lesson and in such circumstances, you will be liable for the cost of the lesson.


While every endeavor is made to commence the lesson at the scheduled time and with the scheduled instructor, no responsibility can be taken for circumstances beyond our control which may delay the start time or result in a change of instructor. If there are circumstances beyond our control which have delayed the start time of your lesson, we will offer you the full lesson time or, if that is not possible, we will offer you a lesson at another time.


You must comply with the instructions or directions of your instructor at all times, before and during a lesson.


We reserve the right to terminate a lesson if:


  • you engage in any behaviour that your instructor determines is reckless; or
  • you fail to comply with the instructions or directions of your instructor before or during a lesson; or
  • you fail to comply with any special conditions on your license, i.e. wearing of glasses/contacts; or
  • your instructor has assessed your driving skills and competence and deems you to be unfit or unsafe to drive (see section 11 “Fitness to drive” below); or
  • you do not comply with the Learner’s Code of Conduct before or during the lesson.


In the event that a lesson is terminated under the circumstances listed above you will be required to pay the full cost of the terminated lesson.


Your instructor will only proceed with your final Drive if they deem you competent and assessment ready. 


Unsuccessful Assessment


If a student is unsuccessful in completing their assessment, depending on which state the current licence is held in, there may be time restrictions in place for when a re-assessment can be conducted. Beck's adheres to the state government’s assessment requirements, which are available in your state's heavy vehicle handbook. As an accredited assessor, we are required to follow the requirement of these standards. There may also be State Government set wait times between an unsuccessful assessment. Beck's are required to adhere to these wait times as part of their accreditation.


Additional charges will apply for any reassessment that is required to be conducted by a Beck's employed or contracted assessor. 


Bribery


It is illegal to offer gifts, money or any forms of bribery to any Beck’s Transport Training staff, instructors and assessors. If you are found to be offering a bribery to any staff member, instructor, assessor or contractor, you may be reported to State Government authorities. 


Vehicles


Use Of Own Vehicle


If you are driving in your own vehicle, Beck’s Transport Training Pty Ltd Instructor must first assess that your vehicle is roadworthy (only a basic external inspection will be carried out). It is your obligation to ensure that your vehicle complies with the following requirements:


  • the registration of your vehicle is valid and current. You acknowledge that it is illegal to drive an unregistered vehicle and warrant that your vehicle is registered.
  • you hold current compulsory third party insurance and comprehensive insurance cover for your vehicle
  • you have notified your insurance company in writing (prior to your first driving lesson in your vehicle) that your vehicle will be used by an instructor to provide driving lessons.
  • the tyres are correctly inflated (air pressures must reflect the manufacturer’s recommendation as a minimum), have appropriate levels of tread and are not damaged. e. all indicators and brake lights are working
  • seats and seat belts are in good working order and are not damaged or twisted
  • any loose items in the cabin of the vehicle are stowed in the cargo area.
  • the windows and interior are clean.
  • the windscreen is not cracked and shows no signs of damage.
  • the vehicle has sufficient petrol to last the course of the lesson (minimum requirement – a quarter of a tank).
  • Meets the correct rating for the licence you are attempting (i.e a HR rated vehicle for a HR licence upgrade)
  • Meets the correct gearbox option as booked (i.e is a synchro gearbox if booked a 1 day course unless confirmed at the time of booking for a 1 day crashbox course option)
  • Is 75% loaded for the training and assessment. The vehicle will be taken over weighbridge to ensure it meets the requirements.


Instructor Supplied Vehicle


Driving lessons are provided in synchro, automatic or non-synchro transmission vehicles.


Instructor supplied vehicles may contain global positioning and monitoring systems with the capacity to identify the location of the vehicle and the manner in which it is operated. Beck's vehicles are fitted with internal and external camera's. Footage from these camera's may be used as a training tool or supplied to State Government authorities if required. 


When using an instructor’s vehicle for a practical driving test and the assessor is present and you fail to follow the directions given by the instructor during the lesson or practical test, you will be responsible for the lower of the cost of repairs relating to damage caused or the insurance excess applicable, should the vehicle be damaged.


You will always be responsible for traffic infringement notices arising while driving our vehicle.


Smoking


Smoking is not permitted on any vehicle supplied by Beck’s Transport Training.


Fitness to drive


If at any time you are assessed as unfit or unsafe to drive during a lesson, your instructor may terminate the lesson immediately and may assume control of the vehicle.


Because the safety of instructors and participants is paramount, instructors will not enter into any discussions with you regarding an unfit or unsafe driving assessment. If you wish to lodge a complaint about the way in which an assessment was made, please contact the Beck’s Transport Training Pty Ltd on 0417 085 445 or info@beckstransporttraining.com.


Limitation of Liability, insurance


Certain State and Commonwealth legislation, including the Consumer and Competition Act 2010 (Cth), imply warranties or conditions or impose obligations which cannot be excluded, restricted or modified except to a limited extent. These Terms do not purport to exclude any statutory rights available to you and must in all cases be read subject to those statutory provisions. Otherwise, we exclude all conditions and warranties which may be implied by law.


To the extent permitted by law, our liability for breach of any implied warranty or condition which cannot be excluded, is restricted, our option, to:


  • the re-supply of the lessons; or
  • the payment of the cost of having the lessons re-supplied.


Except for any liability which cannot be excluded by law or that is caused by our negligence, we, our related bodies corporate and our and their officers, employees, franchisees, contractors and agents shall not be liable for any loss, damage or liability whatsoever which is suffered (including but not limited to indirect or consequential loss) or personal injury suffered or sustained as a result of:


  1. you participating in a lesson as part of the driving lesson; or
  2. your failure or refusal to follow an instruction or direction of your instructor before or during a lesson; or
  3. you being assessed by your instructor as an unfit or unsafe driver; or
  4. your instructor terminating a lesson in any of the circumstances set out in clause 9.8 or11.3; or
  5. you continuing to drive after you have been assessed as unfit or unsafe to drive by your instructor; or
  6. your vehicle being assessed by your instructor as being unsafe to drive and/or un-roadworthy.


You indemnify and agree to keep us and our related bodies corporate and our and their officers, employees, contractors, franchisees and agents indemnified against any loss, damage, liability, costs and expenses in connection with your breach of these terms and conditions or any other legal obligation by you.


Neither we nor our driving instructors accept any liability whatsoever for personal property that is left in any instructor supplied vehicle, your vehicle or on our premises. 


If driving lessons take place in your own vehicle, you warrant that you are covered by compulsory third party insurance and that your vehicle is covered by comprehensive insurance.


We do not accept any responsibility whatsoever for the outcome of any driving test or assessments you take.


This limitation of Liability clause continues to have effect after this agreement is terminated.


Privacy
 

Beck’s Transport Training Pty Ltd collects your personal information in order to provide lessons to you and to assess your driving skills and to assist in internal administration and operations including accounting, risk management, record keeping, archiving, systems development and testing, and staff training. Beck’s Transport Training Pty Ltd may use and disclose your personal information to related bodies.


ACKNOWLEDGEMENTS


You acknowledge that:


  • The instructor has sole discretion as to whether a lesson will commence or continue;
  • The participation in a lesson does not guarantee that you will acquire the necessary skills to pass any driving test;
  • Driving a motor vehicle is an inherently risky activity and there is the risk of significant personal injury or damage to property;
  • We may record telephone calls received or made by us for training and quality      assurance purposes;
  • We do not accept any liability whatsoever for personal property that is left in a vehicle; and
  • If you are not the learner, you have made the Learner aware of these acknowledgements.


Complaints 


Beck’s Transport Training is committed to providing high-quality training and services. We recognize that, at times, clients may have concerns or complaints. This policy outlines the procedure for lodging and resolving complaints in a fair, efficient, and transparent manner.


Policy Statement


Beck’s Transport Training will:

  • Treat all complaints seriously, confidentially, and without prejudice.
  • Resolve complaints promptly, fairly, and efficiently.
  • Use complaints as an opportunity for continuous improvement.
  • Ensure no complainant is disadvantaged or penalized for lodging a complaint.


Procedure


1. Lodging a Complaint - Clients can lodge a complaint through the following methods:


  • In Person: Speak with an instructor or administrative staff member.
  • In Writing: Email complaints to info@beckstransporttraining.com or submit a written complaint to our office.
  • Phone: Call our office at 0417 085 445


Complaints should include:

  • The complainant’s name and contact details.
  • A clear description of the complaint.
  • Relevant dates and names of involved parties.
  • Any supporting evidence or documentation.
  • The desired outcome or resolution.


2. Acknowledgment


Complaints will be acknowledged within three (3) business days of receipt.


The complainant will be informed of the complaint handling process and expected resolution timeframe.

  

1. Investigation and Resolution

  • A designated staff member will review the complaint and gather necessary information.
  • Where appropriate, discussions will be held with relevant parties to seek resolution.
  • If required, the complainant may be invited to a meeting to discuss their concerns.

A decision or resolution will be provided within ten (10) business days. If additional time is needed, the complainant will be informed.


2. Outcome and Communication

The complainant will receive a written response outlining the findings and any corrective actions.


If the complaint is upheld, corrective action will be taken to prevent recurrence.


If the complainant is dissatisfied with the resolution, they may request an internal review or escalate the matter to an external body.


3. External Escalation

If a client is not satisfied with the outcome, they may escalate the complaint to relevant external authorities, such as:

  • The Australian Driver Trainers Association (ADTA).
  • ACT Road Transport Authority – Access Canberra
  • NSW Roads and Maritime Services

4. Record-Keeping and Confidentiality


All complaints and resolutions will be documented and stored securely.

Personal details and complaint information will be handled in accordance with privacy laws.


Complaint data will be reviewed periodically to improve services.


5. Review and Continuous Improvement

This policy will be reviewed annually to ensure effectiveness.


Feedback from complaints will be used to enhance service quality and training practices.
